General Terms and Conditions of Sale (GTC) and Use (GCU)
The general terms and conditions of sale of the LIGE Watches website, represented by the company MG Innovations, apply to all orders and are subject to the conditions listed below.
They prevail over any other written or unwritten stipulation made by the customer. All orders imply full acceptance of these terms of sale, except for special conditions written by LIGE Watches at the time of the order.
It is up to the customer to define their own needs, possibly to establish their specifications, and choose their equipment under their own responsibility.
Shipping conditions
The company MG Innovations entrusts the delivery of orders placed on www.lige-france.com, according to the chosen carrier.
The products are delivered to the delivery address you indicated during the order process.
The shipment of products available in our stock is carried out within a maximum of 3 business days from the day of payment receipt.
Generally, orders placed before 12 PM are shipped the same day (excluding weekends and public holidays), others the next day.
LIGE Watches reserves the choice of carrier and guarantees the proper delivery of the goods.
Shipping costs (VAT included)
Shipping costs depend on the carrier chosen by the customer when placing the order.
Delivery times
The indicative delivery time is specified on www.lige-france.com during the ordering process and depends on the carrier chosen by the customer when placing the order.
The information specified on the site www.lige-france.com regarding delivery times is given for information purposes only. They are non-binding and non-contractual. The shipment of products available in our stock is carried out within a maximum of 3 business days from the day of payment receipt.
Generally, orders placed before 12 PM are shipped the same day (excluding weekends and public holidays), others the next day.
Please note that no items will be delivered on Sundays and public holidays.
If you have ordered items with different delivery times, we deliver by grouped shipment unless otherwise agreed with the customer. In this case, the delivery time is set according to the item you ordered that has the longest delivery time.
Note that although this is extremely rare, it may happen that delivery is delayed by the carrier (package lost by the delivery person in charge of your area, strikes, exceptional closures, etc ....). In such situations, delivery times can take up to 1 month before the package is considered lost.
Product reception
When picking up your order, we invite you to check the general condition of your package before accepting it, and to refuse any damaged package.
Receipt of damaged product
In case of a damaged package received, you must absolutely make reservations when the package is visibly damaged: wet package, torn, carrier's tape on the package (which would indicate that the package was opened during transport), etc.
These reservations must be made upon receipt, in front of the delivery person. Even if they seem in a hurry, the package must be opened and the products checked before their departure.
Indeed, if the damage is noticed after receipt, the carrier will refuse any compensation.
How to make reservations?
The reservations must appear on the delivery proof that you sign upon receipt of the package.
Also note that if the package is damaged but the products are intact, no compensation is to be expected! The packaging is meant to protect the goods, so even if it is damaged, it does not allow for presumption of the goods' poor condition.
Hence the importance of making the delivery person wait to open the package.
Also, you are advised to take as many photos as possible to justify your reservations:
- a photo of the shipping label present on the package;
- a photo of the entire order received in the original package;
- a photo of each damaged product where the damage is clearly visible.
You then just need to send them to us and the support team will provide the necessary documents to obtain compensation
The prices listed on the website are indicated in euros (all taxes included), excluding delivery charges. The prices listed on your order after its validation and registration are firm and final: if prices drop a few days after the order, we will not be able to compensate you for the difference; if prices increase, we are committed to delivering to you at the price set on the day of the order. The prices charged at the time of the order are those in effect in the current valid catalog.
- a) The return can only concern products that have not undergone any alteration and are returned in their original packaging. Software, audio or video recordings, newspapers, products subject to hygiene or health protection constraints, and consumables can only be taken back if they are still in their original intact packaging, sealed and not activated. Article L221-28 of the Consumer Code states the contracts for which the right of withdrawal cannot be exercised. The transport costs and risks are the responsibility of the client for professionals. The only transport costs borne by LIGE France are the costs of reshipping products returned at the client's expense for exchange due to a real operational defect; provided that the client is located in mainland France. No equipment can be exchanged before its return to the premises of MG Innovations. Before returning a backup unit for service by our services, the client must take care to back up their data themselves.
- b) Any claim regarding apparent defects or non-compliance of the delivered product, related to the ordered equipment, must be notified in writing either by registered letter with acknowledgment of receipt or by email to the address: contact@lige-francecom. The equipment cannot be returned or exchanged without the express agreement of MG Innovations.
- c) Packaging is not considered a defect of form rule, so no return will be counted as a defect of form nor guaranteed regarding the packaging of our products.
Payment is due at the time of order, net and without discount. In the absence of payment, MG Innovations will not consider the order. Any delay or default in payment will result in, as a penalty, late interest equal to three times the legal interest rate. All costs that MG Innovations deems necessary to incur to recover the payment are the responsibility of the client. In application of Article L.441-6 of the Commercial Code a compensation of €40 is automatically due by all professionals for each invoice paid late, starting from the first day of late payment, regardless of the applicable transaction period. This compensation is in addition to late penalties and does not preclude the possibility of claiming additional compensation.
The customer has a period of 15 days from receipt of their order to exercise their right of withdrawal. They must notify MG Innovations of their wish to withdraw using the form available on the LIGE France website or by any other clear means. The customer then has a maximum period of 15 days to return their order at their own expense and claim a refund. They must comply with clause 5 - RECEPTION a).
The delivered equipment has an exclusive commercial warranty for a period of 24 months, except for batteries and consumables (6 months).
This exclusive warranty is granted on products purchased only from the LIGE France websites www.lige-france.com
MG Innovations can in no way be held responsible for unforeseeable, indirect, or immaterial damages related to non-compliant use of the product sold by MG Innovations: falls of more than 1m, contact of the product with a significant amount of staining materials, water intake of the product, significant impact, apparent physical breakage on the equipment, or any other rough handling of a precision product.
Any minor stains or scratches applied during packaging by the manufacturing plant are not covered by our product warranty.
The photos are not contractual. You have the right to access, modify, rectify, and delete data concerning you (article 34 of the 'Informatique et Libertés' law of January 6, 1978).
Spare parts listed on our commercial supports will be available for 3 years from the date of purchase of the main product. It is reminded that the benefit of the commercial warranty does not prevent the application of the legal provisions relating to the legal guarantee of conformity and the guarantee against hidden defects (legal guarantees) reproduced below.
Article L217-4 Consumer Code : The seller delivers a good in conformity with the contract and is responsible for any lack of conformity existing at the time of delivery. They are also responsible for any lack of conformity resulting from the packaging, assembly instructions, or installation when it has been charged to them by the contract or carried out under their responsibility.
Article L217-5 Consumer Code : The good is in conformity with the contract:
- If it is suitable for the use usually expected of a similar good and, where applicable: - if it corresponds to the description given by the seller and has the qualities that the seller presented to the buyer in the form of a sample or model - if it has the qualities that a buyer can legitimately expect given the public statements made by the seller, the producer, or their representative, particularly in advertising or labeling;
- Or if it has the characteristics defined by mutual agreement by the parties or is suitable for any special use sought by the buyer, brought to the seller's attention and that the latter has accepted.
Article L217-12 Consumer Code: The action resulting from the lack of conformity is prescribed by two years from the delivery of the good.
Article L217-16 Consumer Code When the buyer requests from the seller, during the course of the commercial warranty granted to him at the time of the acquisition or repair of a movable good, a restoration covered by the warranty, any immobilization period of at least seven days is added to the duration of the warranty that remained. This period starts from the buyer's request for intervention or the provision for repair of the good in question, if this provision is after the intervention request.
Article 1641 Civil Code The seller is liable for the warranty due to hidden defects of the sold item that render it unfit for the use for which it is intended, or that so diminish this use, that the buyer would not have acquired it, or would have given a lower price for it, if he had known them.
Article 1648 paragraph 1 Civil Code The action resulting from redhibitory defects must be initiated by the purchaser within two years from the discovery of the defect.
It is recalled that under the legal guarantee of conformity, the consumer: - has a period of two years from the delivery of the goods to act against the seller;
- can choose between repair or replacement of the goods, subject to the cost conditions provided by Article L. 217-9 of the Consumer Code ;
- is exempt from proving the existence of the lack of conformity of the goods during the six months following the delivery of the goods. This period is extended to 24 months from March 18, 2016, except for second-hand goods.
The legal guarantee of conformity applies independently of any commercial guarantee that may cover your goods. It is recalled that the consumer may decide to implement the guarantee against hidden defects of the sold item as per Article 1641 of the Civil Code and in this case, they can choose between the cancellation of the sale or a reduction of the sale price in accordance with Article 1644 of the Civil Code.
Any improper use of LIGE products such as heavy impacts, falls from more than 1m, contact with liquid, careless handling, voids the product warranty.
Any product returned to the after-sales service and showing damage caused by their use will also not be covered by the warranty.
In case of disputes, our sales department is at the disposal of our customers at the following email address: contact@lige-francecom
The company MG Innovations expressly reserves ownership of the delivered goods until full payment of their price in principal and interest. The mere delivery of a payment instrument does not constitute payment. The above provisions do not prevent the transfer to the buyer of the risks of loss or deterioration. In the absence of full payment, the company MG Innovations will be entitled to demand the immediate return of the delivered equipment. The costs that may be incurred for this return will be borne by the customer.
MG Innovations cannot be held responsible for the non-performance of the concluded contract due to the occurrence of a force majeure event.
Regarding products purchased to meet professional needs, MG Innovations will not incur any liability for any indirect damages arising from these terms, loss of business, loss of profit, damages or expenses that may occur.
LIGE France, like any distributor, collects an eco-contribution from its customers, included in the sale price, to finance the collection and recycling channels of Waste Electrical and Electronic Equipment (WEEE).
For all electrical and electronic equipment products, in accordance with article R.543-180 of the Environmental Code , any customer can benefit from a free take-back right for their WEEE. The request for product take-back must comply with the '1 for 1' principle: LIGE France takes back your old product for any product of the same type purchased as part of the distance selling.
A disposal channel for household electrical and electronic appliances at the end of their life has emerged in France, to ensure environmentally friendly treatment.
Thus, dear consumers and customers, you should no longer throw away end-of-life equipment with other household waste. They contain substances and components that are dangerous for the environment and the health of all of us.
You must deposit them at a collection point provided for this purpose:
By going to the waste collection center of your municipality or city.
The Environmental Code states that in the event of the sale of a household electrical or electronic equipment, the distributor, including in the case of distance selling, takes back or has taken back free of charge on its behalf, the used electrical and electronic equipment that the consumer disposes of, within the limit of the quantity and type of equipment sold.
As a reminder, the request for product take-back must respect the principle of '1 for 1'. : LIGE France therefore takes back your old product free of charge for any new product of the same type purchased on the site. If the product requires the intervention of a carrier, the take-back will be done by the carrier who came to deliver to you.
